We reserve the right to cancel the order in case of non-payment, return of charges, denied card or false data or in case we are not able to verify your card or account details.



4. HOW TO PURCHASE OUR PRODUCTS.

The User undertakes that he/she will respect these General Conditions of Sale.

The sale will be made by performing the following steps:

1. The User, when accessing the website, must register in order to make purchases, although he/she can wait to do so until the time of payment of the products.

2. To register as a Customer, you must provide a 'username', an 'email' and an 'access key'. The customer must provide truthful information about the data requested in the forms and accept these General Conditions of Sale.

4. The User must select the products he/she wishes to purchase, adding the products to 'Cart'. Once the products have been chosen, to continue with the operation, 'finish purchase' must be selected.

6. The User may enter coupon codes to apply the price promotion which may deducted from the final price of the basket of the purchase of products from AGUSTÍ TORELL, S.A.

GUSTÍ TORELL, S.A. uses the global service payments which incorporates the SSL security rule so that confidential data (the 16-digit bank card number, the expiration date, the CSV code) is transmitted directly in encrypted form to the bank's server, without the information being registered on the server of AGUSTÍ TORELL, S.A..



5. PRICES FOR THE SERVICES AND SHIPPING OF THE PRODUCTS.

The prices of the services are indicated in euros and include taxes related to the sale of Products, including VAT.

AGUSTÍ TORELL, S.A. reserves the right to modify the price of its products unilaterally through its website. To guarantee the User the certainty of the price of its services, the price will be that established in advertisements at the moment of purchase/formalization of the order.



6. SHIPPING OF PRODUCTS.

AGUSTÍ TORELL, S.A. will ship its products throughout the Spanish territory with the exception of Balearic Islands, Canary Islands, Ceuta and Melilla.

All orders will be delivered within 72 hours at the address once the purchase process has been formalized and completed by the User.

In the event of delays in these delivery times, being for reasons beyond our control, no right of compensation will be generated in favour of the customers, who will be informed of the delay.

The freight will be free if the User makes a minimum purchase of 1 box.



7. WARRANTY

At AGUSTÍ TORELL, S.A. we strive to provide services of the highest quality, in case, for any reason, you do not receive the product or service correctly, you must inform us as soon as possible indicating the incident, in order to correct as soon as possible if the error is verified.



8. RETURNS.

The following conditions in reference to the return of our products do not apply in the case of the right of withdrawal is exercised.

Returns or changes of the products will only be accepted in the case of factory defect, damage due to transport or delivery errors. In any case, no more than 14 days must have elapsed since the receival of the product by the User and the packaging and accessories must be included. It shall be verified prior to acceptance that this is a manufacturing or packaging defect or anomaly and not because of improper or negligent use, handling, or storage. The products will always be accompanied by the corresponding delivery note or invoice.

In the case that the products are to be returned due to issues related to the manufacture, packaging or because there is an issue related to the product in its entirety, we offer the following to the customer. We offer, if possible, to repair the product or replace it with another alternative at no additional costs and compensation to the User. The costs generated by the shipment of the repaired or compensated order will be borne by AGUSTÍ TORELL, S.A.

In any case, the returned product(s) will always be subject to prior examination by AGUSTÍ TORELL, S.A. to establish the condition of the returned product and verify that the requirements needed have been met. Once the return has been received, and these conditions have been met, we will process the new products to be sent within a maximum period of 30 days, using the same data that was used to make the payment.

AGUSTÍ TORELL, S.A. reserves the right to refuse returns communicated or sent outside the deadline or products that are not in the same condition in which they were received.



9. RIGHT OF WITHDRAWAL.

Given the nature of the product (perishable product) and its conditions of preservation and in accordance with Article 103(d) and (e) of Royal Legislative Decree 1/2007, of November 16,in defense of Consumers and Users, the right of withdrawal does not apply to this contract.

The right of withdrawal shall apply only in the case of the provision of services. You have the right to withdraw from this contract within 14 calendar days without justification, except for contracts relating to:

a) The provision of services, once the service has been fully executed, when the execution has begun, with the express consent of the consumer and user and with the recognition on his/her part that he/she is aware that, once the contract has been fully executed by the employer, he/she will have lost the right of withdrawal.

b) The supply of goods or the provision of services whose price depends on fluctuations in the financial market which the business owner cannot control and which may occur during the withdrawal period.

c) The supply of goods are made according to consumer and user specifications or clearly customized.

d) The supply of goods that may deteriorate or expire rapidly.

e) The supply of sealed goods that are not suitable for return for health or hygiene reasons and which have been unsealed after delivery.

f) The supply of goods which, after their delivery and taking into account their nature, have been indissociably mixed with other goods.

g) The supply of alcoholic beverages whose price was agreed at the time of the execution of the sale contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations which the supplier cannot control.

h) Contracts in which the consumer and user have specifically requested the supplier to visit him/her for urgent repair or maintenance operations; if, on that visit, the supplier provides additional services to those specifically requested by the consumer or supplies goods other than spare parts typically used to carry out maintenance or repair operations, the right of withdrawal applies to said additional services or goods.

i) The provision of sealed sound or video recordings or sealed software that has been unsealed by the consumer and/or user after delivery.

j) The provision of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the provision of such publications.

k) Contracts concluded through public auctions.

l) The provision of accommodation services for purposes other than housing, transport of goods, car rental, food or services related to recreational activities, if the contract specifies a specific date or period of execution.

m) The provision of digital content that is not provided physically, when the execution has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.

11. APPLICABLE LAW AND JURISDICTION.

These conditions shall be governed by and construed in accordance with Spanish law. For the resolution of all disputes or issues related to this website or the activities carried out on it, Spanish law will apply, to which the parties expressly submit, being competent for the resolution of all disputes arising out of or related to their use by the Courts and Tribunals of Barcelona. However, it will be mandatory that in the event of a conflict the parties first attempt to resolve the matter by mutual agreement.

This business undertakes the responsibility to not permit any transaction that is illegal, or any transaction that may have the potential to damage or adversely influence the goodwill of credit card brands or the bank in question. The following activities are prohibited under card brand programs: the sale or offer of a product or service that is not in full conformity with all laws applicable to Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited: 'Sale of alcoholic beverages to children under 18 years of age.
